Terms of Service for MangoMatch

Welcome to MangoMatch, a service provided by TGM Ventures, Inc. ("MangoMatch", "we", "us", or "our"). Our services include, but are not limited to, our website, mobile applications, chatbots, AI matchmakers, and any other services we provide now or in the future (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Refund Policy, and any additional terms applicable to certain parts of our Service, which together form a legally binding agreement between you and MangoMatch. If you do not agree to all the terms and conditions of this agreement, you should not use or access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, members, contributors of content, and if applicable, advertisers. By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications. We may amend these Terms at any time by posting the amended terms on our Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms. In such a case, "you" and "your" will refer to that organization.

Please read these Terms carefully to ensure that you understand each provision. These Terms include information about future changes to these Terms, limitations of liability, a class action waiver, and resolution of disputes by arbitration instead of in court.

Eligibility: By using MangoMatch, you affirm that all of the following statements are true:

• You are an individual acting in a personal capacity and not on behalf of any other entity or organization.
  You are at least 18 years old or the age of majority in your jurisdiction, whichever is higher, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.
• You are not located in any country that is subject to a U.S. Government embargo, or designated by the U.S. Government as a “terrorist-supporting” country.
• You are not listed on any U.S. Government list of prohibited or restricted parties.
• You are not prohibited by law from using our Services.
• You have not been convicted of a felony, a sex crime, or any crime involving violence, or listed on any state, federal, or local sex offender registry.
• You do not have more than one account on our Services and have not been previously removed from our Services unless you have received our express written permission to create a new account.
  
  User Conduct: In engaging with MangoMatch and its community, you agree to:
• Comply with these Terms and regularly review updates.
• Abide by all applicable laws, including privacy, intellectual property, and regulatory standards.
• Engage in honest and transparent communication with other users, avoiding any form of deception.
• Use discretion and good judgment in the content you post, ensuring it is appropriate and respectful to the community.
• Provide accurate and current information in your profile to foster trust and authenticity within the community.
• Report any suspicious or inappropriate behavior or content to MangoMatch support to help maintain a safe and welcoming environment.
• Refrain from sharing or posting content that could be considered offensive, provocative, or incites negativity or harm.
• Participate in the community with the intention of forming genuine connections, respecting the diverse backgrounds and perspectives of all members.
• Protect the confidentiality and privacy of conversations and information shared with you by other users.
• Avoid any actions that would impair the functionality or accessibility of the MangoMatch service for other users, including but not limited to, overloading the service infrastructure or software.
• Be mindful and considerate of other users' boundaries and consent, never pressuring anyone for personal information, meetings, or any form of interaction they are uncomfortable with.
• Contribute to a positive and supportive atmosphere that encourages friendly interactions and relationships among MangoMatch members.
  
  Prohibited Activities: You are expressly prohibited from:
• Misrepresenting your identity or affiliations.
• Engaging in or promoting illegal or harmful activities.
• Harassing or intimidating other users.
• Posting content that violates MangoMatch's content guidelines.
• Soliciting personal information from others without explicit consent for commercial or unlawful purposes.
• Participating in fraudulent activities or scams.
• Infringing upon or encouraging the violation of intellectual property rights.
• Disabling or circumventing security features of the Service; reverse engineering or attempting to discover the source code of the Service, except as permitted by law.
• Disrupting the operation of the Service, including spreading viruses or making unsolicited offers or advertisements.
• Using any automated means to access or scrape MangoMatch content without permission.
• Creating multiple accounts, using another user's account, or accessing the Service after being banned or removed without MangoMatch's express permission.
• Posting illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable content.
  
  Account Security: You are responsible for maintaining the confidentiality of your login credentials you use to sign up for MangoMatch, and you are solely responsible for all activities that occur under those credentials. If you think someone has gained access to your account, please immediately contact support@mangomatch.com.
• Account Responsibility: You are solely responsible for your interactions with other MangoMatch users. We reserve the right, but have no obligation, to monitor disputes between you and other users. MangoMatch shall have no liability for your interactions with other users, or for any user’s action or inaction.
• By using MangoMatch, you agree to abide by these rules and acknowledge that violating them may result in suspension or termination of your account.

Ownership of Your Content: As a user of MangoMatch, you retain all rights and ownership to the content you create, share, or post on the service, including texts, images, videos, and other materials ("Your Content"). MangoMatch does not claim any ownership over Your Content but requires certain licenses to operate our Service effectively.

Grant of License to MangoMatch: By sharing Your Content on MangoMatch, you grant us a global, non-exclusive, royalty-free, sublicensable, and transferable license to use, display, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and publicly perform Your Content in connection with the Service and MangoMatch's business operations. This license is necessary for promoting, improving, and developing our Service and allows us to make Your Content available to other users. You confirm you have the rights necessary to grant this license for any content you post on MangoMatch.

Your Content Representations and Warranties: You warrant that you either own Your Content or have all the necessary licenses, rights, consents, and permissions to use and to authorize MangoMatch to use it as described in these Terms. You are solely responsible for Your Content and the consequences of sharing it on the Service, and you represent that it does not and will not infringe upon the rights of any third party.

Content Responsibility and Review: We strive to maintain a respectful and safe community, but we cannot monitor or control all content posted by users. We encourage you to report any content or behavior that violates our policies. While we reserve the right to review, monitor, or remove content, such actions are at our discretion and not an obligation. MangoMatch is not responsible for the accuracy, integrity, quality, or authenticity of any content posted by users.

Prohibited Content: You agree not to post, upload, or share content that is unlawful, libelous, defamatory, obscene, pornographic, invasive of privacy, harassing, abusive, discriminatory, or otherwise objectionable. MangoMatch reserves the right, but not the obligation, to remove or disable access to any content that violates these prohibitions or any other part of these Terms, at our sole discretion and without prior notice.

Content Removal: You may delete Your Content from the Service at any time. However, you acknowledge that MangoMatch may retain archived copies of your content and that the license you grant to us survives the deletion of Your Content.

Feedback: Any feedback, comments, or suggestions you may provide regarding MangoMatch is entirely voluntary, and you agree that MangoMatch may use such feedback without obligation to you.

AI Matchmaker Service: MangoMatch offers an AI Matchmaker, referred to as "Sara", which utilizes advanced algorithms and artificial intelligence (AI) to facilitate matchmaking among users. By using MangoMatch, you agree to the use of Sara for creating potential matches based on the preferences and information you and other users provide.

Accuracy and Limitations: While Sara is designed to enhance your matchmaking experience by suggesting compatible matches, MangoMatch does not guarantee that Sara's suggestions will always meet your expectations or that all recommendations will lead to successful connections. The effectiveness of Sara's suggestions may vary based on the accuracy and completeness of the information provided by you and other users.

Your Interactions with Sara: You acknowledge that interactions with our AI Matchmaker are governed by these Terms. You agree not to misuse or manipulate Sara for unlawful purposes or in a manner that could impair the functionality or performance of MangoMatch's services.

Data Use and Privacy: In providing matchmaking services, Sara processes and analyzes your profile information and preferences. MangoMatch is committed to respecting your privacy and ensuring the security of your data. Our use of data through Sara is subject to the terms outlined in our Privacy Policy. By using Sara, you consent to the processing of your data as described in these Terms and our Privacy Policy.

Feedback and Improvements: MangoMatch welcomes feedback on Sara's performance and suggestions for improvements. By providing feedback, you grant MangoMatch a perpetual, non-exclusive, royalty-free license to use such feedback for any purpose, including but not limited to, improving Sara and developing new features and services.

Disclaimer of Warranties: MangoMatch provides the AI Matchmaker "as is" and without any warranty of any kind, either express or implied. While MangoMatch strives to provide a high-quality matchmaking experience, we do not warrant that Sara's suggestions will always be accurate, complete, or useful for every user.

Limitation of Liability: To the fullest extent permitted by applicable law, MangoMatch will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of or reliance on Sara's matchmaking suggestions or your interactions with suggested matches.

Changes to AI Matchmaker: MangoMatch reserves the right to modify, suspend, or discontinue the AI Matchmaker service at any time without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of Sara.

Privacy Commitment: At MangoMatch, we deeply respect the privacy of our users. We are committed to maintaining the confidentiality of your profile and the personal information it contains. Our practices regarding the collection, use, and disclosure of your information are detailed in our Privacy Policy.

Profile Visibility: Your MangoMatch profile is designed to be visible to other MangoMatch members to facilitate matchmaking. However, we take stringent measures to ensure that your profile information is accessible only to users who have successfully completed our screening process and have become members of MangoMatch. Non-members or users who have not passed our screening process will not have access to detailed profile information.

Example Profiles: To showcase our service to potential users, we may display "example" profiles. These profiles are based on aggregated or fictionalized data and do not correspond to actual users. Any resemblance to real persons, living or dead, is purely coincidental.

Information Sharing with Matches: By using MangoMatch, you agree to the sharing of your profile information with potential matches as suggested by our AI Matchmaker, "Sara." This sharing is integral to the matchmaking process and is done with the aim of establishing meaningful connections. You have control over the information you provide and can adjust your privacy settings to limit what is shared.

Data Protection: We employ robust security measures to protect your information from unauthorized access, alteration, disclosure, or destruction. Please review our Privacy Policy for more information on our data protection practices.

Your Responsibilities: You are responsible for the information you choose to share on MangoMatch and with other users. Please exercise caution and good judgment when sharing personal details, especially with new matches.

Changes to Privacy Practices: MangoMatch reserves the right to modify our privacy practices and policies. Any changes will be communicated through our Service, and your continued use of MangoMatch after such notice will constitute your acceptance of the changes.

Copyrights and Trademarks: The Service and its original content, features, and functionality are and will remain the exclusive property of MangoMatch and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MangoMatch.

User Contributions: MangoMatch claims no ownership over any personal data, messages, images, or profiles (collectively, "User Content") that you upload, post, email, transmit, or otherwise make available on the Service; however, by doing so, you are granting MangoMatch a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and MangoMatch's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.

Protection of Intellectual Property: We respect the intellectual property rights of others and expect users of the Service to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your content has been copied in a way that constitutes copyright infringement, please provide us with the following information: a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; identification of the copyrighted work claimed to have been infringed; identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; your contact information, including your address, telephone number, and an email address; a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Subscriptions: MangoMatch offers various subscription plans to access premium features of the Service ("Subscription(s)"). By subscribing, you agree to pay the subscription fee specified at the time of purchase. Subscription fees are billed on a recurring basis, according to the term of the subscription plan selected (monthly, quarterly, annually, etc.).

Payment: You authorize us to charge your payment method for the Subscription fee and any applicable taxes and service fees. All fees are non-refundable, except as required by law or as explicitly stated in our refund policy. Prices for Subscriptions may change at any time, but such changes will not affect your current Subscription term and will only come into effect upon renewal.

Automatic Renewal: Your Subscription will automatically renew at the end of the subscription period, unless you cancel it before the renewal date. You acknowledge and agree that we are authorized to use the payment information on file to charge the renewal subscription fee and any applicable taxes and service fees.

Cancellation: You may cancel your Subscription at any time. Cancellation will take effect at the end of the current subscription period, and you will continue to have access to the Subscription until the end of that period. To cancel, follow the instructions in the Service settings or contact our customer support at support@mangomatch.com.

Refund Policy: Our Refund Policy is available on our website. Generally, all payments to MangoMatch are non-refundable, including the Subscription fees. However, we may, at our discretion, provide refunds in specific circumstances as outlined in our refund policy.

Changes to Subscription Plans: MangoMatch reserves the right to modify, terminate, or otherwise amend our offered subscription plans. In the event of a material change to a subscription plan, we will provide you with notice as required by law.

Free Trials: From time to time, we may offer free trials for certain Subscriptions. If you enter into a free trial, we will begin to bill your payment method at the end of the free trial period unless you cancel your Subscription before that time. Please be aware that some portions of the free trial terms may vary and will be specified at the time of the trial offer.

Informal Resolution: Before initiating any formal legal proceedings, you and MangoMatch agree to first attempt to resolve any disputes (whether related to these Terms, the use of our Service, or otherwise) informally by contacting support@mangomatch.com. We aim to resolve disputes amicably and efficiently; hence, we'll try to address your concerns without the need for legal action within 30 days of notification.

Agreement to Arbitrate: In the event that an informal resolution is not achieved, you and MangoMatch agree to resolve any disputes arising out of or in connection to these Terms or the Services exclusively through final and binding arbitration, rather than in court, except as stated under "Exceptions to Agreement to Arbitrate" below.

Arbitration Location: The arbitration shall be conducted solely in King County, Washington State, United States. This location reflects our agreement to centralize the arbitration process, making it predictable and accessible for both parties.

Arbitration Procedures: Arbitration will be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes, to the extent applicable.

Arbitration Fees and Costs: The payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules. MangoMatch will not seek its attorneys' fees and costs in arbitration unless the arbitrator deems your claim to be frivolous.

Exceptions to Agreement to Arbitrate: You and MangoMatch both retain the right to seek relief in small claims court for disputes or claims within that court's jurisdiction, provided such disputes take place in King County, Washington State. Furthermore, we both agree that either party may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

No Class Actions: You may only resolve disputes with MangoMatch on an individual basis and may not bring a claim as a plaintiff or class member in any class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and any form of consolidation with other arbitrations are not permitted.

Judicial Forum for Disputes: In the unlikely event that arbitration is found not to apply to your claim or dispute, both you and MangoMatch agree that any judicial proceedings will be brought in the federal or state courts of King County, Washington State. Both parties consent to venue and personal jurisdiction in these courts.

Changes to This Arbitration Agreement: Any future changes to this arbitration agreement, with the exception of a change to MangoMatch's address for Notice, will not affect your rights unless you expressly agree. If changes are made, you have the right to reject any such change by sending us written notice within 30 days to MangoMatch's provided address for Notice, upon which your account with MangoMatch will be terminated and the existing arbitration agreement at the time of your rejection will remain in effect.

Choice of Law: These Terms and any action related thereto will be governed by the laws of the State of Washington, United States, without regard to or application of its conflict of law provisions or your state or country of residence. All claims, legal proceedings, or litigation arising in connection with the Service will be brought solely in King County, Washington, United States, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.

Consistency with Applicable Law: If you are accessing or using the Service from a jurisdiction with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that through your continued use of the Service, which is governed by U.S. law, you are transferring your personal information to the United States and you consent to that transfer.

International Users: MangoMatch is based in and operates its services from the United States. We make no representations that our Service is appropriate or available for use in other locations. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

Legal Effectiveness: The laws of Washington State govern these Terms and your use of the Service, and you irrevocably consent to the jurisdiction of the courts located in King County, Washington, for any action to enforce these Terms. The UN Convention on Contracts for the International Sale of Goods will not apply to these Terms.

Dispute Resolution Venue: For any disputes not subject to arbitration, or in cases where the arbitration agreement is deemed unenforceable or inapplicable, legal proceedings must be initiated in the state or federal courts located in King County, Washington, United States. You and MangoMatch agree to submit to the personal jurisdiction of these courts for the purpose of litigating all such disputes.

For Section 9 of the MangoMatch Terms of Service, focusing on "Modifications to the Service and Prices," consider the following text:

Service Changes: MangoMatch reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We continually evolve and innovate to offer the best possible experience to our users. Accordingly, the features and functionality of the Service may change over time. While we aim to provide advance notice of significant changes, we may not always be able to do so due to various reasons, including urgency or regulatory compliance.

Price Adjustments: Prices for our services, including but not limited to subscription plan fees, are subject to change without notice. Such price changes will be effective immediately for new users and upon renewal for existing subscribers. We will make reasonable efforts to provide subscribers with advance notice of any changes to subscription fees to offer an opportunity to cancel before the renewal if they do not agree to the price change.

User Notification: We will notify you about any material changes to the Service or prices through the email address associated with your account, through the Service itself, or through any other method we deem appropriate to ensure you are informed.

Continued Use after Changes: Your continued use of the Service after the posting of any modifications to the Service or changes in prices constitutes your acceptance of those changes. If any change to the Service or prices is not acceptable to you, your only remedy is to cease using the Service and, if applicable, cancel your subscription.

Cancellation Rights: Subscribers may cancel their subscriptions at any time. Cancellation procedures are detailed in Section 6 of these Terms. Please be aware that cancelling your subscription due to changes in the Service or prices does not entitle you to a refund of any previously paid subscription fees.

Responsibility for Monitoring Changes: It is your responsibility to check the Service periodically for changes. We aim to provide a transparent communication channel regarding any changes to the Service or pricing to ensure you are always informed and can make decisions based on the most current information available.

Usage of Third-Party Services: MangoMatch utilizes various third-party services, including software as a service (SaaS) products, cloud services, payment processors, and analytics tools, to facilitate the operation, enhancement, and analysis of MangoMatch. These services are integral to providing a seamless experience, maintaining our infrastructure, processing transactions, and improving our service offerings.

Integration with Third-Party Services: Our Service may integrate with or offer links to websites, applications, and services operated by third parties. These integrations and links are provided for your convenience and to deliver additional functionality. While we strive to choose reputable third-party services, MangoMatch does not endorse, nor is it responsible for, the privacy practices, content, or performance of third-party sites and services.

User Discretion and Agreement: When you interact with third-party services, you do so at your own risk, and you agree that MangoMatch is not liable for any damages or losses caused by your use of or reliance on these services. You are responsible for reviewing and agreeing to the terms and privacy policies of any third-party service you access, as your use of these services will be governed by those policies and not by MangoMatch’s Terms of Service.

Dynamic Nature of Third-Party Services: The specific third-party services used by MangoMatch may change over time as we adapt to new technologies and services that enhance our platform. We encourage users to remain informed about our use of third-party services by reviewing our Terms of Service and Privacy Policy periodically for updates.

Data Sharing: By using MangoMatch, you acknowledge and agree to the potential sharing of your information with third-party services to the extent necessary for the operation and improvement of the Service, in accordance with our Privacy Policy.

Pre-screening and Background Checks: MangoMatch endeavors to foster a safe and trustworthy community by attempting to pre-screen members and, in certain cases, conducting background checks or criminal background checks. While these efforts are aimed at enhancing the safety and integrity of the Service, MangoMatch does not guarantee the accuracy, completeness, or effectiveness of these screening processes. We make no representations or warranties regarding the past behaviors, criminal history, or intentions of any member.

Limitation of Guarantees: The screening and background checks we may perform are based on information provided by third parties, and therefore, we cannot guarantee that every member is free of criminal history or possesses good intentions. The results of our vetting and pre-screening processes should not be taken as a guarantee of safety or compatibility.

AS IS and AS AVAILABLE Basis: The Service and all interactions facilitated through it are provided on an AS IS and AS AVAILABLE basis. MangoMatch expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

User Responsibility: You assume full responsibility for your interactions with other members. MangoMatch encourages you to take all necessary precautions when interacting with other users, especially if you decide to communicate outside the Service or meet in person. MangoMatch is not responsible for the conduct of any member or for the outcomes of any interactions that occur as a result of using the Service.

Content and Conduct: While MangoMatch may review or monitor the content posted by members and their conduct, we are under no obligation to do so. We do not endorse, support, represent, or guarantee the truthfulness, accuracy, or reliability of any member's content or endorse any opinions expressed by members.

Jurisdictional Limitations: Some jurisdictions do not allow the exclusion of certain warranties, so the above disclaimers may not fully apply to you. In such jurisdictions, MangoMatch's liability will be limited to the greatest extent permitted by law.

Assumption of Risk: By using MangoMatch, you acknowledge and agree that there are risks involved in using an online platform to interact with others, and you agree to assume all such risks, including but not limited to, the risk of physical harm, dealing with strangers, underage persons, or people acting under false pretenses.

Scope of Liability: To the maximum extent permitted by applicable law, MangoMatch, its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Cap on Liability: In no event will MangoMatch's aggregate liability for all claims relating to the Service exceed the greater of $100 USD or the amount you paid MangoMatch, if any, in the last 12 months.

User Acknowledgment: You acknowledge and agree that we have made the Service available to you and entered into these Terms in reliance upon the warranty disclaimers and limitations of liability set forth herein, which reflect a reasonable and fair allocation of risk between you and MangoMatch and form an essential basis of the bargain between us.

Jurisdictional Variations: Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. In such jurisdictions, MangoMatch’s liability is limited to the greatest extent permitted by law.

Essential Services: MangoMatch provides a platform for connecting individuals and does not guarantee the behavior, actions, or validity of any user. You are solely responsible for your interactions with other users and agree to exercise caution and good judgment in all such interactions.

User Obligations: You agree to defend, indemnify, and hold harmless MangoMatch, its parent company, subsidiaries, affiliates, officers, agents, employees, partners, and licensors from any claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising from:

• Your Use of the Service: Any use of the MangoMatch Service that is not in accordance with these Terms or as intended by MangoMatch.
• Violation of Terms: Your violation of any term of these Terms, including without limitation, your breach of any of the representations and warranties above.
• Third-Party Claims: Any claim that your actions, including the content you submit, post, transmit, or make available through the Service, caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the MangoMatch Service.
• Violation of Laws: Your violation of any law or the rights of a third party.
• User Interactions: Your interactions with any other MangoMatch users or meetings arranged through MangoMatch, including, without limitation, injuries, losses, or damages (compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of such interactions or meetings.
• Indemnification Procedure: MangoMatch will provide notice to you of any such claim, suit, or proceeding and will assist you, at your expense, in defending any such claim, suit, or proceeding. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with MangoMatch in asserting any available defenses.

Limitation of Claims: Indemnification by you covers all expenses, damages, and costs resulting from defending any claims, including but not limited to, court costs and attorney's fees.

Essential Agreement: This indemnification is considered an essential part of these Terms, and it is intended that this indemnification fully complies with your obligations under the Terms. The obligations under this section will survive the termination or expiration of these Terms and/or your use of the MangoMatch Service.

Right to Modify: MangoMatch reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms of Service at any time by posting the amended Terms on the MangoMatch website or within the Service itself. It is your responsibility to check these Terms of Service periodically for changes. Your continued use of the Service following the posting of changes will mean that you accept and agree to the changes.

Notification: Whenever significant changes are made to these Terms of Service, we will make a reasonable effort to notify you through the Service, or through other means such as email. However, it remains your responsibility to review the Terms regularly to ensure you are updated on any changes.

Upon your request to terminate, your account will be deactivated, and you will no longer have access to your account or any content or data associated with it.

Termination by MangoMatch: MangoMatch reserves the right to suspend or terminate your account, access to our Service, or any part thereof, at any time, without notice, for any reason, including, but not limited to, breach of these Terms, upon the occurrence of any prohibited activity as outlined in these Terms, or any behavior that we, in our sole discretion, consider harmful to our community or the operation of our Service.

Effects of Termination: Upon termination, all licenses and rights granted to you in these Terms will immediately cease, and you must cease all use of the Service. We may also delete your account and all related information and files in your account without liability to you. We are not obligated to return any content or data to you upon termination.

Survival: Termination of your account does not affect any accrued rights and obligations of either you or MangoMatch up to the date of termination, including the right to seek redress for violations of these Terms. Additionally, any provisions of these Terms that by their nature should survive termination will remain in effect, including, but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Reactivation: In certain cases, you may be able to reactivate your account by following the reactivation procedures specified by MangoMatch, provided that your account was not terminated for cause due to violation of these Terms or engaging in illegal or harmful behavior.

Post-Termination Access: MangoMatch does not guarantee that any content or data you have uploaded to the Service will be retrievable following termination. We encourage you to maintain your own backup of any important content or data.
